Changes on HB1534 Up for Vote

Late last night, Rep. Eiland made progress persuading Rep. Taylor (our advocate) that his bill needed to be passed without any amendment exempting TPAs/Employers. Apparently, this is the “only bill that TMA is really pushing this session” and “passage would be an unfair competitive advantage for TPA’s”. Understanding that these are not valid issues, they nonetheless put pressure on Taylor to back off. PLEASE REACH OUT TO ANY OF THE FOLLOWING COMMITTEE MEMBERS BEFORE 1pm TO KILL THIS BILL. The vote is supposed to come up again at 1:00 today. I have already spoken to many of you, but we need to keep our fight for liberty in the forefront with these members. I am attaching Adam Russo’s and his Team’s legal assessment for reference and have highlighted some of the many good points to quickly look at. Remember, this creates a new cause of action under the Unfair Claim Settlement Practices which would expose TPA’s and employer’s into yet more legal risk. If the providers don’t like the contractual terms they entered into with a PPO, then they should terminate their contracts – not legislate others to be responsible for their bad decisions.
