St. Paul, Minn. — Commercial health insurers are scrambling for position as a key part of the federal health law threatens to upend their marketplace in two years.
Health plans are trying to lock in business before government-sponsored health insurance exchanges go online in 2014. Several large insurers are launching private insurance exchanges to protect themselves against competition from the public exchanges.

Minnesota. The Minnesota house has approved cuts to state health and welfare programs, in an attempt to erase a $5 billion deficit without increasing state taxes. The bill would eliminate a Medicaid expansion for 100,000 adults, coverage would expire for 7,200 adults under MinnesotaCare, and give other MinnesotaCare enrollees subsidies to buy private health insurance. In addition, the state legislature is considering a plan to provide vouchers to low-income state residents to buy health care coverage in the private marketplace. State Republicans said that the voucher program would cap the state’s liability and provide low-income individuals with responsibility for their own care. A pair of litigators have teamed up to bring an ERISA class action suit against the Publishing House of the Evangelical Lutheran Church in America.
Specifically, the law firms of Keller Rohrback L.L.P. and Lockridge Grindal Nauen P.L.L.P. announced Friday that they have filed an ERISA class action complaint on behalf of a class of all persons who were participants in or beneficiaries of the Retirement Plan for Employees of Augsburg Fortress Publishers, Publishing House of the ELCA, from January 1, 2000 to the present. Minnesota. Starting March 1, the state is going to charge counties extra to cover the cost of health care for their neediest residents. Previously, a $400 million General Assistance Medical Care program was available to help provide coverage for the poorest in the state, but the program is ending in an attempt to balance the budget. State legislators have proposed funding the program through surcharges on hospitals and health groups to draw down federal dollars and would levy a 10% match by counties to share the program’s cost. The Minnesota Senate and House both agree that it is essential for victims of the Interstate 35W bridge collapse to be compensated for their losses, however, the amount of proposed settlement funds are in opposition. The Senate bill would establish a $25 million fund while the House bill would establish a $40 million fund. The Senate bill would set a limit on how big the victim’s settlement would be. The Senate bill voids settlement negotiations based on the severity of injuries, loss of income, or pain and suffering for family members, whereas, the House bill proposes no such limitations on individual victim settlements. Recently, in the wake of last August’s horrific bridge collapse on I-35 in Minnesota over the Mississippi River, state lawmakers in Minnesota are attempting to establish a recovery fund to ensure that victims in the disaster receive compensation for their losses. The problem is that a great majority of the victims had their medical coverage provided by ERISA governed welfare benefit plans. The politicians do not want any compensation to reach the hands of the insurance companies, who seek reimbursement through their subrogation provisions.State lawmakers are thus working on legislation to ensure that survivors’ insurers won’t be able to claim any of the money that insureds may receive in settlement. Due to rising health care costs, many of the health plans involved are increasingly laying claim to the money patients have won in settlement through subrogation action. (more…)
